Operating rules for businesses using Keepers Loyalty
These terms set out the rules for using Keepers Loyalty as a hosted loyalty platform. They cover who may use
the service, how accounts and customer data must be handled, what billing obligations apply, and the limits
around platform availability and liability.
01 Acceptance and scope
These terms apply when a business creates an account, invites team members, uses a public signup page, or accesses any Keepers Loyalty dashboard, API, export, or related service. By using the platform, you agree to these terms on behalf of yourself and, if relevant, the business you represent.
02 Eligibility and account control
You must provide accurate account details and keep login credentials secure. If an account is used by staff, contractors, or collaborators, the business account owner remains responsible for access management, permissions, and activity performed through that account.
03 Customer data and compliance
You are responsible for the personal information you collect through your loyalty program, how you describe that collection to your customers, and how you use exported or synced contact data after it leaves the platform. If your business is an APP entity under the Privacy Act 1988 (Cth), you must comply with the Australian Privacy Principles in relation to any personal information you collect, use, or disclose through the platform. If you send commercial electronic messages to customers, you must comply with the Spam Act 2003 (Cth), including obtaining appropriate consent and providing a functional unsubscribe mechanism. You must also comply with any other privacy, consumer, or marketing laws that apply to your business and location. Keepers Loyalty's own collection and handling of personal information is described in our Privacy Policy.
04 Fees, billing, and plan changes
Paid features are billed using the pricing and billing terms shown when you subscribe or upgrade. Unless required by law or stated otherwise, fees already charged for an active billing period are not refundable. We may change pricing or packaging in the future, but changes will not apply until after reasonable notice. Nothing in this section limits any statutory rights you may have under the Australian Consumer Law.
05 Acceptable use
You may not use the service for unlawful marketing, unsolicited commercial messaging contrary to the Spam Act 2003 (Cth), phishing, misleading promotions, credential abuse, scraping, security testing without permission, or any activity that could harm customers, merchants, or the platform. You also may not interfere with the reliability or performance of the service.
06 Suspension and termination
You may stop using Keepers Loyalty at any time. We may suspend or terminate access if we reasonably believe an account has violated these terms, poses a security or fraud risk, fails to pay required fees, or creates legal exposure for the service. Where practical, we may allow a limited data export period before permanent closure.
07 Privacy
Keepers Loyalty collects and handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our Privacy Policy, available on our website, explains what personal information we collect, how we use and disclose it, whether it may be disclosed to overseas recipients, and how you can access, correct, or make a complaint about information we hold. By using the platform, you acknowledge that we process personal information as described in our Privacy Policy. If you have a complaint about how we handle personal information, you may contact us in the first instance, or contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
08 Governing law and disputes
These terms are governed by the laws of Victoria, Australia. If something goes wrong, we'd always prefer to sort it out directly — please reach out before taking formal steps. If a dispute does arise, both parties agree to make a genuine effort to resolve it in good faith first. For anything that does need to go further, the courts of Victoria and the federal courts of Australia sitting in Victoria have jurisdiction. Either party may still seek urgent relief from a court if the situation genuinely calls for it.
Service availability
Keepers Loyalty is provided on an as-available basis. We aim for dependable operation, but outages, maintenance windows, third-party provider failures, or bugs may affect access, reporting, or message delivery.
Intellectual property
We retain ownership of the platform, software, branding, and product materials. You retain ownership of your business content and customer records, subject to the rights needed for us to host, process, secure, and support the service.
Liability limits
Nothing in these terms excludes, restricts, or modifies any right, remedy, guarantee, or warranty implied or imposed by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded or limited. Subject to those non-excludable rights, and to the maximum extent permitted by law, Keepers Loyalty is not liable for indirect, incidental, special, consequential, or punitive losses, or for lost profits, lost business opportunities, or losses caused by customer misuse, third-party tools, or service interruptions outside our reasonable control. Where the Australian Consumer Law permits us to limit liability for a failure to comply with a non-excludable guarantee in relation to services, our liability is limited, at our election, to re-supplying the services or paying the cost of having the services re-supplied.
Changes to the service or these terms
We may improve, modify, or discontinue parts of the service as the product evolves. We may also update these terms. When changes materially affect your rights or obligations, we will update the date on this page and provide notice through the product or the account email where appropriate.
